1. ABOUT THESE TERMS
Welcome to Wagvora.
These Terms of Service govern your access to and use of the Wagvora website, online store and related products, features and services.
In these Terms, “Wagvora”, “we”, “us” and “our” refer to the operator of the Wagvora online store. “You” and “your” refer to any visitor, customer or person using our website or purchasing from us.
By accessing our website, creating an account or placing an order, you agree to these Terms of Service.
Our Privacy Policy, Shipping Policy and Refund Policy also form part of these Terms. Please read those policies before placing an order.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian law.
2. ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a binding agreement to place an order through our store.
You agree to provide accurate, current and complete information when placing an order, creating an account or communicating with us.
You are responsible for keeping your account login information secure and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without authorisation.
We may ask you to verify your identity, payment information or order details when reasonably required to prevent fraud or protect customers.
3. PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, measurements, photographs, prices and other information displayed on our website are accurate.
Product colours and appearance may vary slightly depending on lighting, photography, manufacturing variations and the screen or device used to view the product.
Minor variations that do not materially affect the product’s function may occur. This does not limit your rights where a product is faulty, unsafe, materially different from its description or otherwise fails to comply with the Australian Consumer Law.
Product availability, specifications and designs may change. Any change will not affect an order already accepted by us unless you agree to the change or the change is required by law.
4. VEHICLE FIT AND PRODUCT USE
Vehicle interiors, seat dimensions, headrests, footwells and anchorage points vary between makes, models and production years.
Any vehicle compatibility information we provide is a general guide unless we expressly guarantee compatibility with a particular vehicle.
You should check the product measurements and measure your vehicle carefully before ordering. This does not limit your rights if measurements or compatibility information provided by us is inaccurate or misleading.
Products must be installed and used in accordance with the supplied instructions and any warnings displayed on the product or product page.
Unless expressly stated on the relevant product page, a seat cover, back-seat extender or similar accessory is not a certified vehicle safety restraint and must not replace any animal restraint required by law.
You should ensure that any product:
- is installed securely;
- does not obstruct seatbelts, airbags, doors, child-restraint anchorage points, controls or driver visibility;
- is suitable for your vehicle and intended use; and
- is used together with appropriate and lawful animal-restraint arrangements.
You should stop using a product if it becomes damaged, unstable or unsafe.
5. ORDERS AND ACCEPTANCE
Submitting an order is an offer by you to purchase the selected products.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that we have accepted the order.
Your order is accepted when we send confirmation that it has been processed or dispatched.
We may decline or cancel an order before acceptance where reasonably necessary, including because:
- the product is unavailable;
- payment could not be authorised;
- the delivery address is unsupported;
- there is an obvious pricing or product-information error;
- the order appears fraudulent or unauthorised; or
- we are otherwise unable to fulfil the order.
If we cancel an order after receiving payment, we will notify you and refund the amount paid for the cancelled products using the original payment method.
We may apply reasonable purchase limits where necessary to manage stock, prevent fraud or stop unauthorised commercial resale.
Please review your order and delivery details before submitting it. Contact us promptly if you need to request a change or cancellation. We cannot guarantee that changes or cancellations will be possible after processing or dispatch has begun.
6. PRICES, TAXES AND PAYMENT
All prices are displayed in Australian dollars unless clearly stated otherwise.
The displayed product price includes any GST or other tax that is legally required to be included.
Delivery charges and any optional additional costs will be shown before you complete payment.
We will not impose an unavoidable fee without disclosing it as part of the total price where required by law.
Prices and promotions may change before an order is accepted. Price changes will not be applied retrospectively to an accepted order.
If an obvious pricing error is identified before your order is accepted, we may contact you and offer the option to proceed at the correct price or cancel the order for a full refund.
Payments are processed through Shopify and available third-party payment providers. Your use of a payment method may also be subject to the provider’s terms and privacy practices.
You confirm that you are authorised to use the payment method supplied for your order.
7. DISCOUNTS AND PROMOTIONS
Promotional offers and discount codes may be subject to additional conditions displayed with the promotion.
Unless otherwise stated:
- discount codes cannot be exchanged for cash;
- only one discount code may be used per order;
- discounts cannot be applied retrospectively;
- offers remain subject to availability; and
- promotions may be changed or withdrawn before an order is accepted.
Any promotional conditions will be applied consistently and will not limit rights available under the Australian Consumer Law.
8. SHIPPING AND DELIVERY
Shipping destinations, charges, processing information and delivery estimates are described in our Shipping Policy and at checkout.
Delivery dates and timeframes are estimates unless we expressly state that a delivery date is guaranteed.
We will take reasonable steps to dispatch and deliver orders within the timeframe communicated to you. Delays may occur because of carriers, severe weather, natural disasters, industrial action, customs processes, incorrect address information or other circumstances outside our reasonable control.
We remain responsible for complying with our obligations under the Australian Consumer Law despite using a supplier, fulfilment provider or delivery carrier.
Risk of loss or damage remains with us until the order is delivered to the delivery address or received by a person authorised to accept it on your behalf.
You are responsible for providing a complete and accurate delivery address. Additional delivery costs resulting solely from an incorrect address provided by you may be charged where reasonable and permitted by law.
Contact us at support@wagvora.com if your order is significantly delayed, lost or arrives damaged.
If we cannot supply an order within the stated timeframe or, where no timeframe was stated, within a reasonable time, you may have rights to cancel the order and receive a refund under the Australian Consumer Law.
9. RETURNS, REFUNDS AND CONSUMER GUARANTEES
Returns, refunds and exchanges are handled in accordance with our Refund Policy and the Australian Consumer Law.
Our goods come with automatic consumer guarantees that cannot be excluded.
Products must be of acceptable quality, be safe and durable, match their description, be fit for any disclosed purpose and have no undisclosed security interests.
Where a product has a major failure, you may be entitled to reject the product and choose a refund or replacement, as well as compensation for reasonably foreseeable loss or damage where applicable.
Where a failure is not major, we may be entitled to provide an appropriate remedy within a reasonable time, such as a repair or replacement.
The remedy available will depend on the circumstances and the requirements of the Australian Consumer Law.
We may request reasonable evidence of the issue, such as photographs, videos, order information or return of the product. We will not impose unreasonable requirements that prevent you from exercising your legal rights.
Consumer guarantees do not generally cover damage caused by abnormal use, deliberate damage, misuse, failure to follow reasonable instructions or ordinary wear and tear, unless the product was not sufficiently durable or instructions were inadequate.
We are not required to provide a refund solely because you changed your mind unless our Refund Policy expressly provides a change-of-mind return right.
10. ACCURACY OF INFORMATION
We may correct typographical errors, inaccurate product information, stock information or technical issues displayed on the website.
Corrections made after an order has been accepted will not remove or reduce your existing rights.
We will not substitute a materially different product without your agreement.
11. INTELLECTUAL PROPERTY
The Wagvora website and its content, including its branding, logos, product descriptions, graphics, photographs, illustrations, videos, layout and design, are owned by or licensed to us and are protected by Australian and applicable international intellectual-property laws.
You may access and use the website for personal and non-commercial purposes.
Unless permitted by law or authorised by us in writing, you must not:
- reproduce or republish substantial website content;
- sell, license or commercially exploit our content;
- remove copyright or trademark notices;
- use our branding in a misleading manner; or
- imply that you are affiliated with or endorsed by Wagvora.
Third-party trademarks and content remain the property of their respective owners.
12. CUSTOMER CONTENT, REVIEWS AND FEEDBACK
You may be able to submit reviews, photographs, comments, questions or other content.
You confirm that content you submit:
- is truthful and based on your genuine experience;
- does not infringe another person’s rights;
- is not unlawful, threatening, defamatory, discriminatory or obscene;
- does not contain malware, spam or misleading advertising; and
- does not disclose another person’s private information without permission.
You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and use it for operating and promoting Wagvora.
We may moderate or remove content that breaches these Terms, is fraudulent, contains prohibited material or is unrelated to the product or service.
We will not remove or suppress a genuine review merely because it is negative.
13. ACCEPTABLE USE
You must not use our website or services to:
- break any law;
- commit fraud or impersonate another person;
- interfere with the website’s security or operation;
- introduce viruses, malicious code or harmful material;
- obtain unauthorised access to accounts, systems or data;
- collect personal information unlawfully;
- send spam or unsolicited commercial messages;
- infringe intellectual-property rights;
- harass or threaten another person; or
- scrape or extract substantial website content without permission, except where permitted by law or our published technical instructions.
We may reasonably restrict access where necessary to investigate fraud, protect security or prevent a material breach of these Terms.
14. THIRD-PARTY SERVICES AND LINKS
Our website may use or link to third-party services, including payment providers, delivery providers, analytics services, social-media platforms and other applications.
Third-party services may be governed by their own terms and privacy policies.
We are not responsible for the content or practices of a third-party website that we do not control.
Nothing in this section limits our responsibility for products we sell, representations we make or obligations we owe under the Australian Consumer Law.
15. SHOPIFY
Our online store is hosted using Shopify.
Shopify provides the ecommerce platform and technical services that allow us to operate our store. Purchases made through the Wagvora store are transactions between you and Wagvora, not between you and Shopify.
Shopify may process information in accordance with its own privacy obligations and policies.
16. PRIVACY
We collect, handle and disclose personal information as described in our Privacy Policy.
By using our website or placing an order, you acknowledge that your information may be processed by Shopify, payment providers, delivery providers and other service providers necessary to operate the store and fulfil your order.
Please review our Privacy Policy for more information about how personal information is handled and how to contact us about privacy matters.
17. WEBSITE AVAILABILITY
We aim to keep our website available, accurate and secure but cannot guarantee uninterrupted access at all times.
Access may occasionally be interrupted for maintenance, technical failures, security issues or circumstances outside our reasonable control.
We may update, suspend or discontinue a website feature where reasonably necessary. This will not affect rights relating to an accepted order.
18. LIABILITY
Nothing in these Terms excludes, restricts or modifies:
- the Australian Consumer Law;
- liability that cannot lawfully be excluded; or
- any right or remedy available to you under applicable law.
We remain responsible for reasonably foreseeable loss or damage caused by our failure to comply with a consumer guarantee or other legal obligation.
To the maximum extent permitted by law, we are not responsible for loss or damage that:
- was not reasonably foreseeable;
- was caused by your unlawful use or misuse of a product;
- resulted from failure to follow clear installation, safety or care instructions;
- was caused by an unauthorised alteration to the product; or
- was caused solely by circumstances beyond our reasonable control.
Any limitation in these Terms applies only to the extent permitted by law.
19. SUSPENSION OR TERMINATION
We may suspend or terminate access to an account where reasonably necessary because of fraud, security risks, unlawful conduct or a serious breach of these Terms.
Where practical, we will provide notice and an opportunity to address the issue.
Suspension or termination does not remove rights relating to an existing order, refund, consumer guarantee or privacy request.
20. CHANGES TO THESE TERMS
We may update these Terms to reflect changes to our products, website, business practices or legal obligations.
Updated Terms will be published on this page with a revised “Last updated” date.
Changes apply to future website use and future orders. The Terms applying when an order was accepted will continue to govern that order unless a change is required by law or agreed with you.
21. SEVERABILITY
If a provision of these Terms is found to be unlawful or unenforceable, it will be read down or removed only to the extent necessary.
The remaining provisions will continue to apply.
22. NO WAIVER
If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.
23. ENTIRE AGREEMENT
These Terms and the policies referred to in them form the agreement between you and Wagvora regarding your use of our store and your purchases.
They do not exclude any representation, guarantee or right that cannot lawfully be excluded.
24. GOVERNING LAW
These Terms are governed by the laws of South Australia and the Commonwealth of Australia.
You and Wagvora submit to the non-exclusive jurisdiction of the courts of South Australia and any courts entitled to hear appeals from them.
Nothing in this section prevents you from exercising a right in another jurisdiction where applicable law permits you to do so.
